1. Agreement to Terms

These Terms and Conditions of Use (“Terms”) govern your access to and use of www.facilityriskservices.com and any related services, forms, subscriptions, documents, or digital tools provided by Facility Risk Services (“FRS,” “we,” “us,” or “our”). By accessing or using the Site, you accept these Terms. If you do not agree, do not use the Site.

2. Services Provided

Facility Risk Services is a subscription-based platform offering digital resources including, but not limited to:

  • Emergency Action Plans (EAP)

  • Maintenance, operations, safety, and facility management forms

  • Medical and incident reporting forms

  • Staff training content and risk-management resources

We may update, modify, or discontinue any portion of the Services, features, or content at any time.

3. Account & Subscription Requirements

To access premium content, users must create an account and maintain an active subscription. Users agree to:

  • Provide accurate registration information

  • Maintain confidentiality of their login credentials

  • Ensure account activity complies with these Terms

You are responsible for all activity under your account.

We reserve the right to suspend or terminate accounts for violations of these Terms.

4. Payment, Billing, Refund & Cancellation Policy

A. Payment and Billing

  • Subscription fees are billed at the time of purchase and renew automatically unless canceled before renewal.

  • Prices may change; any price change will apply at your next renewal.

  • Payments are processed securely by third-party providers; FRS does not store credit card numbers.

B. Refund Policy

Because subscribers gain immediate access to digital forms, proprietary templates, and restricted resources, all subscription fees are generally non-refundable.

Refunds will not be issued for:

  • Failure to cancel before renewal

  • Change of mind or lack of use

  • Staff turnover or organizational changes

  • Termination due to violation of these Terms

Refunds may be considered only in the following limited cases:

  • Duplicate charges or accidental duplicate subscriptions

  • Billing error caused by FRS

  • A verified technical issue preventing access to the Services that cannot be resolved

Approved refunds will be returned to the original payment method only.

C. Cancellation Policy

  • You may cancel your subscription at any time through your account settings or by contacting us.

  • Cancellation stops future billing but does not issue a refund for previous charges.

  • You will retain access to Services until the end of your paid billing cycle.

D. Data Access After Cancellation

  • When a subscription ends, the user’s access to forms, tools, and features is disabled.

  • All submitted data will remain stored indefinitely unless the account owner formally requests deletion.

5. License of Use

FRS grants subscribers a limited, non-exclusive, non-transferable license to access and use Site content for internal organizational purposes only.

You may not:

  • Resell, share, redistribute, or publish FRS materials outside your organization

  • Provide system access to non-subscribed users

  • Copy, modify, reproduce, or reverse-engineer any content, software, or materials

Violation may result in termination of access without refund and potential legal action.

6. Data Ownership & Retention

  • Users retain ownership of data submitted into forms and systems.

  • By using the Site, you allow FRS to store and maintain this data as part of your account history.

  • Data is retained indefinitely, even after cancellation, unless deletion is requested by the authorized account holder.

7. User Responsibilities

Subscribers are responsible for:

  • Ensuring accuracy, compliance, and legality of all data entered

  • Obtaining consent before entering personal or medical information of others

  • Using forms in a manner consistent with applicable laws, privacy regulations, and governing standards

FRS is not responsible for misuse or inaccurate use of forms.

8. Intellectual Property

All Site content—including forms, templates, training, design, branding, documents, images, and software—is owned by Facility Risk Services and protected under U.S. and international copyright laws.

Unauthorized reproduction, distribution, or use is prohibited.

9. Third-Party Tools & Links

The Site may include integrations or links to third-party sites. FRS is not responsible for the content, privacy practices, or policies of third-party services.

10. Disclaimer of Warranties

The Site and Services are provided “as-is” and “as-available.” FRS does not warrant that:

  • The Site will be uninterrupted or error-free

  • All forms meet every regulatory requirement for all industries

  • Data will not be lost (although reasonable safeguards are in place)

Users are responsible for verifying compliance requirements for their specific industry or organization.

11. Limitation of Liability

To the fullest extent allowed by law, FRS is not liable for:

  • Loss of business, revenue, profits, data, or goodwill

  • Errors, downtime, or interruptions in service

  • Inaccurate or incomplete user entries or misuse of forms

Your sole remedy for dissatisfaction with the Services is to discontinue using the Site.

12. Indemnification

You agree to hold harmless and indemnify Facility Risk Services, its owners, employees, affiliates, and contractors from any claims arising from:

  • Your misuse of the Site or Services

  • Your violation of these Terms

  • Data you submit or manage through the Services

13. Governing Law

These Terms are governed by the laws of the State of North Carolina. Any disputes shall be resolved exclusively in state or federal courts located in North Carolina.

14. Changes to Terms

FRS reserves the right to modify these Terms at any time. Updates will be posted with a revised Effective Date. Continued use of the Site after changes means you accept the updated Terms.
