I hereby voluntarily and willingly request access to the sideline areas during Averett University football games (“Event”). In consideration of being granted access to the sideline areas, I agree to the following terms and conditions:<ol><li>Assumption of Risk: I understand and acknowledge that participating in any activities on the sideline during the Event involves inherent risks, including but not limited to the risk of personal injury or death, property damage, or other harm. I voluntarily assume all such risks and agree that Averett University, its officers, agents, employees, and representatives (collectively referred to as “Averett”), shall not be liable for any injuries, damages, or losses that I may sustain during my presence on the sideline during the Event.</li><li>Release and Waiver of Liability: I hereby release and discharge Averett from any and all claims, demands, causes of action, liabilities, costs, and expenses (including attorney’s fees) arising out of or related to any injury, loss, or damage that may occur during my presence on the sideline during the Event. This release and waiver apply to all known and unknown risks and are intended to be binding upon myself, my heirs, executors, administrators, and assigns.</li><li>No Guest Access: I understand that I am not allowed to have any guests or visitors accompany me on the sideline during the Event. Access to the sideline is strictly limited to Averett University alumni who have been issued appropriate credentials by Averett.</li><li>Credential Requirement: I agree that I will only gain access to the sideline during the Event if I possess the proper credentials issued by Averett University. I understand that I must follow all instructions and guidelines provided by Averett related to credential issuance and use.</li><li>Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the state of Virginia, without regard to its conflict of law principles.</li></ol>By signing below, I acknowledge that I have carefully read and fully understand this Waiver and Release Agreement, and I voluntarily agree to its terms and conditions.
